New York Trailer Brake and Inspection Requirements

NY Trailer Brake Requirements

New York State law (Vehicle and Traffic Law §375) requires brakes on trailers based on their weight. The general thresholds are:

• Trailers with a GVWR over 3,000 lbs are required to have brakes on all wheels.
• Trailers with a GVWR of 1,000–3,000 lbs may be required to have brakes depending on the tow vehicle's gross weight and the trailer's loaded weight.
• Trailers under 1,000 lbs GVWR are generally exempt from brake requirements.

Additionally, any trailer that can be towed at speeds over 40 mph must have brakes that can be applied from the tow vehicle cab. Most modern trailers use electric brakes controlled by a brake controller mounted in the tow vehicle.

Breakaway brakes are required on trailers with a GVWR over 3,000 lbs. A breakaway system applies the trailer's brakes automatically if the trailer separates from the tow vehicle.

Types of Trailer Brakes

There are two main types of trailer brakes used on trailers sold in New York:

• Electric brakes — the most common type on cargo, dump, equipment, and livestock trailers. They require a brake controller in the tow vehicle. The controller senses deceleration and sends a proportional electrical signal to the trailer's brake magnets. Electric brakes are reliable, adjustable, and work well on trailers from 3,500 to 30,000+ lbs GVWR.
• Surge brakes — common on boat trailers and some smaller utility trailers. They use a hydraulic actuator at the coupler that activates the brakes when the trailer pushes forward against the tow vehicle during deceleration. No brake controller is required. Surge brakes are not permitted on trailers used for towing behind vehicles with regenerative braking (some hybrids and EVs) without special approval.

Annual Inspection Requirements

In New York State, trailers with a GVWR over 1,000 lbs that are registered for road use are required to pass an annual safety inspection. The inspection covers:

• Brakes (function, adjustment, and condition)
• Lights (brake lights, turn signals, running lights, reflectors)
• Tires (tread depth, condition, inflation)
• Wheels and wheel bearings
• Coupler and safety chains
• Frame and structural integrity
• Breakaway system (if required)

Inspections must be performed by a NYS-licensed inspection station. The inspection sticker is placed on the trailer's tongue or frame. Trailers that fail inspection cannot be legally operated on public roads until repairs are made and the trailer passes re-inspection.

Registration and Title

All trailers operated on New York public roads must be registered with the NY DMV. Registration requirements vary by trailer type and weight:

• Trailers under 1,000 lbs empty weight may qualify for a permanent registration (one-time fee).
• Trailers over 1,000 lbs require annual registration renewal.
• Commercial trailers have additional requirements based on use and weight.
